1. Operator & Acceptance

Nosbreak is operated as an independent fan project. By using our services, you confirm that you are at least 16 years old (or have parental consent where required), that you have read and understood these Terms and our Privacy Policy, and that all information you provide is accurate.

2. No Affiliation with NosTale

Nosbreak is a fan-made private server and is not affiliated with, endorsed by, or connected to NosTale or its rights holders. NosTale is a trademark of its respective owners. All game-related assets, names, and references remain the property of their respective owners. Use of Nosbreak does not grant you any rights to official NosTale intellectual property.

3. Account Registration & Security

• You may register one account per person unless staff explicitly allows otherwise.
• You are responsible for keeping your login credentials confidential and for all activity on your account.
• Sharing, selling, or trading accounts is prohibited unless explicitly permitted by server rules.
• We may suspend or terminate accounts that violate these Terms or our Server Rules.

4. Virtual Goods, NBCoins & Donations

All payments on Nosbreak — including NBCoins, shop items, fortune wheel spins, lottery entries, and other purchases — are treated as voluntary donations to support the private server. By completing a payment, you acknowledge and agree that:

• Virtual items, NBCoins, and in-game benefits have no real-world monetary value and are not legal tender.
• All payments are final and non-refundable. No refunds of money or coins will be issued after payment is completed.
• Purchases are made at your own risk.
• We do not guarantee availability, permanence, or specific value of virtual goods. Items, prices, drop rates, and balances may be changed, removed, or reset for balance, maintenance, or rule enforcement.
• You will not initiate chargebacks or payment disputes for reasons covered by these Terms. Fraudulent chargebacks may result in permanent account termination.
• Delivery of purchased items is tied to your selected in-game character. You are responsible for selecting the correct character before checkout.

5. Acceptable Use & Prohibited Conduct

You agree not to:

• Use cheats, bots, exploits, hacks, or unauthorized third-party tools
• Harass, threaten, or discriminate against other players or staff
• Attempt to gain unauthorized access to our systems or other players' accounts
• Engage in real-money trading (RMT) unless explicitly allowed by server rules
• Impersonate staff or misrepresent your affiliation with Nosbreak
• Use the service for any unlawful purpose

Full rules are listed on our Rules page. Violations may result in warnings, item removal, NBCoin forfeiture, temporary bans, or permanent account termination without refund.

6. Service Availability

Nosbreak is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access, error-free operation, or preservation of game progress, items, or accounts. We may perform maintenance, updates, wipes, or shutdowns at any time, with or without notice. Progress loss due to technical issues, updates, or rule enforcement is at your own risk.

7. Intellectual Property

Website content, custom features, logos, and original materials created by the Nosbreak team remain our property or that of respective contributors. You may not copy, redistribute, or commercially exploit Nosbreak materials without permission. User-generated content (e.g. forum posts, support messages) may be used by us for moderation and community purposes.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Nosbreak and its operators, staff, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, virtual items, progress, or profits arising from your use of the service. Our total liability for any claim related to a specific purchase shall not exceed the amount you paid for that transaction in the 30 days preceding the claim.

9. Account Termination

You may stop using Nosbreak at any time. We may suspend or terminate your access immediately if you breach these Terms, our rules, or applicable law. Upon termination, you forfeit access to your account and any associated virtual goods without compensation or refund.

10. Changes to These Terms

We may update these Terms at any time. Changes take effect when posted on this page with an updated date. Continued use after changes constitutes acceptance. For material changes affecting purchases, we will make reasonable efforts to notify users.

11. Governing Law & Disputes

These Terms are governed by the laws of Spain, including applicable consumer protection legislation (Real Decreto Legislativo 1/2007 and related rules). Mandatory consumer rights in your country of residence within the EU remain unaffected. For disputes, the parties submit to the courts of the operator's place of residence in Spain, unless mandatory law provides otherwise. We encourage resolving disputes amicably via our support channels before pursuing legal action.
